- CRAZY JAPAN CONTENT AND GRANTING OF EXCLUSIVE USE RIGHT

3.3 The user may be obligated to compensate credit card companies and third parties, such as their agents, for damages should it come to light that he/she has purchased the service using a credit card not registered in his/her name . 3.4 The user shall be required to immediately report to "erogro.com" any credit card loss/theft, or any change of credit card expiration date arising from clear security violations including the use of illegal card number or password.
3.5 The user shall be obligated to unconditionally compensate the Company for damages in the event that he/she has used a found/stolen credit card to purchase the service.
- DECLARATION, GUARANTEE AND PLEDGE OF GOODWILL
4.1 The user shall declare, guarantee and pledge the following.
(a) As per the terms and conditions contained in this user agreement, no material submitted by the user or its subsequent use by "erogro.com" shall in any way, shape or form:
(i) subvert, plagiarize or otherwise violate any third-party rights including copyrights, trademark rights, privacy, the right to psychological well-being, contracts, ownership rights or any other personal rights.
(ii) contain slanderous or otherwise illegal material.
(iii) fabricate false accounts or spread unfounded rumors regarding concluded agreements
(iv) defame, insult or slander any corporation or private person
(v) violate in any way, shape or form the rights of any corporation or private person
(vi) infringe on any law, regulations or other rules set forth by the State(b) The user shall be of legal age (at least 18-21 depending on the state or country in which he/she resides). The user shall hereby vow to release "erogro.com" and all of its board members, managers, owners, information contributors and the like (collectively referred to as "indemnifiers") associated with it from any and all compensatory and other responsibilities arising from non-compliance with the user agreement and/or with any declaration, guarantee or security described therein. The user shall be held accountable for all such punitive payments including but not limited to lawyer's fees within reason, thereby ensuring that indemnifiers are exempt from all liabilities and suffer no loss under any circumstance whatsoever. In all cases, the user shall be expected to assist in all efforts to protect the indemnifiers from damage to the best of his/her ability.
4.2 "Erogro.com" shall neither declare nor vouch for the accuracy or trustworthiness of any advice, opinion, article or other pieces of information displayed, uploaded or distributed through the service by the user, information contributors, or any other corporate or private persons.
"Erogro.com", the service, the software for accessing the service (defined below) or any material provided by "erogro.com" or third parties through the service shall remain unchanged in any way, shape or form. Under no circumstances shall "erogro.com" guarantee its service's commodity value, usefulness, purpose, consistency with and absolute endorsement of various rights. - SOFTWARE
5.1 The user shall have no ownership right whatsoever to 1) the software and related documents used to access the service or 2) any revision or expansion kit thereto (collectively referred to as "the software for accessing the service") . The user shall not be allowed to re-issue, allocate or transfer the permission to use the software granted by "erogro.com", and such acts and the results thereof shall be invalid. The only exception to the "no-copy" rule shall exist in cases where the user copies the software for back-up purposes. The user shall not be allowed to duplicate, revise, reverse-engineer, or manufacture imitations of the software for accessing the service.
- TERMINATION OF CONTRACT
6.1 "Erogro.com" reserves the right to terminate or cancel the user's access to the service, in whole or in part, however it sees fit for any reason whatsoever including but not limited to violations of the terms and conditions set forth by the operating Company of the service.
6.2 The user shall agree to raise no objection whatsoever in the event that the website administrator terminates his/her access to the service without prior notice owing to such user violations as obstructing, disrupting or otherwise undermining the operation of the service, or illegally altering or accessing any of the website's content/functions. The above shall also apply in cases where the user has contributed or sent illegal material, threatened or misled any other user or company personnel, displayed aggressive behavior toward "erogro.com", contributed destructive material including false user names, placed an advertisement, or falsely assumed the identity of another individual or "erogro.com" personnel.
- MISCELLANEOUS
7.1 This user agreement shall be drafted, construed and applied as per pertinent laws of the Netherlands, and shall be submitted to the District Court of Amsterdam, the Netherlands.
